Subject to the terms and conditions set forth below, Members of the Z Rewards Program may earn Points in association with the performance of certain activities and/or the purchase of qualifying Products made on the Z Palette website only. Points earned may be redeemed toward the purchase of qualifying Products on the Z Palette website only. The interpretation and application of the Z Rewards Program, and its terms and conditions are at the sole discretion and determination of Z Palette.
These terminologies have the following meanings unless indicated otherwise: Affiliate is a business or an authorized Z Palette retailer of that sells Products. Application is the online application form that Individuals are required to complete to become a Member of Z Rewards Program. Bonus Points are Points that a Member may earn by participating in promotional incentive programs. Benefits are the facilities, services, products, discounts, offers, activities, events or arrangements that may be offered to Members for participating in the Z Rewards Program. Individual is the person that applies for Membership. Member is a member of the Z Rewards Program. Membership is being a Member of the Z Rewards Program. Points are points that a Member can accrue from qualifying purchases made and/or participating in non-purchase activities. Products are makeup, makeup accessories, and like products that Z Palette offers for retail sale. Program is the Z Palette Z Rewards Program. Retail Price is the purchase price paid for qualifying Products on the Website, whether at full price, a promotional price, or sale price. Rewards are the discounts offered through the redemption of Points on a Product purchase. VIP (ZIP) Status is the status a Member can achieve through a minimum Point accrual in the Z Rewards Program. Website is the Z Palette website found at www.zpalette.com. Z Rewards Program is the name of the retail program that Z Palette offers to that Members can earn Points and other Benefits through participation.
2. Z Rewards Participation
2.1 Individuals are not required to make a purchase to obtain Membership into Z REWARDS.
2.2 Individuals are under no obligation to apply to be a Member of Z REWARDS.
2.3 Individuals are under no obligation to be a Member of Z REWARDS to make purchases on the Website.
2.4 Individuals may not be a Member of more than one Z Palette rewards program, commercial program, or professional program.
2.5 Individuals can only have one Member account at any time.
2.6 Z Palette exercises its discretion to offer Z REWARDS and has no obligation to offer such program to Individuals.
2.7 Individuals who are Members may terminate participation at any time, and may do so by visiting the Website.
2.8 Z REWARDS is void where prohibited by law.
3. Z Rewards Eligibility and Application
3.1 Individuals acknowledge that they are 13 years or older at time of Membership application.
3.2 Individuals under the age of 18 must obtain consent from a parent or legal guardian prior to participation.
3.3 By submitting an application for Z REWARDS, you and/or your parent or legal guardian agree to be bound by these terms and conditions.
3.4 Z Palette exercises its discretion to accept or reject any application from an Individual for Membership.
3.5 To apply for Z REWARDS, Individuals must provide all of the following information: First Name, Last Name, Mailing Address, Email Address, Birthdate, and Phone Number.
3.6 Individuals may apply to become a Member of Z REWARDS by visiting the Website.
3.7 Individuals who are currently and solely registered users of the Website are not automatically enrolled into Z REWARDS and will have to enroll into Z REWARDS separately.
4. Z Rewards Membership
4.1 Z REWARDS and its Membership Rewards and Benefits remain the property of Z Palette.
4.2 Z REWARDS Membership and its Rewards and Benefits are not transferable, not for sale, and not for barter.
4.3 Membership approval will be communicated electronically, and no physical card will be created.
4.4 If a Member forgets their login or password, Member must reset by visiting the Website and follow the prompts.
4.5 Member cannot create multiple accounts, and merge Points, Benefits, or Rewards associated with multiple accounts.
4.6 If a Member is issued a new Membership account, any and all Points balances, whether positive or negative, will be transferred to the new Membership account.
4.7 Z Palette is not responsible for activity resulting from fraudulent use, including but not limited to (a) use of a Member’s account, Points, Rewards or Benefits; (b) redemption of a Member’s account, Points, Rewards or Benefits; (c) usage of redeemed Points, Rewards, or Benefits prior to Member informing Z Palette that Membership accessibility has been compromised.
5. Member Information and Account Maintenance
5.1 Member must be signed in to the Program to access account information and update their profile.
5.2 Member is responsible to maintain accurate personal information of Membership account by visiting the Website.
5.3 Z Palette assumes no responsibility for errors caused by incorrect Member information submitted.
6. Z Rewards VIP (Z.I.P) Membership Eligibility
6.1 Members may be eligible to earn a VIP (ZIP) status and are under no obligation to earn VIP (ZIP) status.
6.2 Members will earn VIP (ZIP) status after achieving a minimum benchmark spend of $250 in qualifying Products within a 12-month period.
6.3 VIP (ZIP) status will be effective fifteen (15) days after achieving a minimum benchmark spend of $250 in qualifying Products, and VIP (ZIP) status will be valid for a period of twelve (12) months after the benchmark is achieved.
6.4 To maintain VIP (ZIP) status, Member must achieve a minimum benchmark spend of $150 in qualifying Products each subsequent year to maintain status. Members who do not maintain this benchmark will lose VIP (ZIP) status and and all associated Rewards and Benefits.
7. Z Rewards VIP (Z.I.P) Membership Rewards and Benefits
7.1 Members with a current VIP (ZIP) status may be offered additional Rewards and Benefits, or promotional offers such as, but not limited to: (a) a higher Point earning rate of 1.25 Points for every one US dollar spent; (b) an annual birthday gift or offer; (c) an ability to earn additional Points; (d) access to exclusive Z.I.P. VIP Member events; (e) exclusive educational and tutorial content; and (f) priority access to purchases.
7.2 If Z.I.P. VIP Member is invited to a special event, Z.I.P. VIP Member may be required to present proof of identification and/or proof of participation and eligibility to gain admittance.
8. Points Accrual
8.1 Members can earn Points though a qualifying Products purchase made on the Website, or through a non-purchase activity.
8.2 Points are earned on the Retail Price of qualifying Products only.
8.3 Members earn one (1) 1 Point for every one (1) US Dollar spent on the purchase of qualifying Products.
8.4 Z.I.P. VIP Members earn 1.25 Points for every one (1) US Dollar spent on the purchase of qualifying Products, when all VIP maintenance criteria are met.
8.5 Any and all Points accumulated in relation to Retail Price paid are rounded down to the nearest US Dollar.
8.6 Members must be signed in to Program at the time of purchase to accumulate Points, otherwise Member forfeits eligibility to earn Points on such purchases.
8.7 Points are not transferable, not for sale, and not for barter.
8.8 Neither credit nor cash will be given for unused Points.
8.9 Points accrued for a qualifying purchase, after applied to an account, may only be redeemed for subsequent purchases.
9. Points Accrual Exclusions
9.1 Points cannot be purchased.
9.2 Points cannot be earned on purchases made from Z Palette Affiliates.
9.3 Points cannot be earned on Products purchased from another Z Palette rewards program, commercial program, or professional program.
9.4 Points cannot be earned for the purchase of Z Palette Gift Cards; however, Points can be earned for the purchases made with a Z Palette Gift Card.
9.5 Points cannot be earned for charges related to taxes, delivery, fees, or surcharges paid in association with the delivery of qualifying Product purchases.
9.6 Points cannot be earned on transactions and amounts that include redemption of merchandise vouchers, store credit, price adjustments, merchandise returns, discount applied, or credits amount received.
9.7 Points cannot be earned if Individual was not a Member of Z REWARDS at the time of purchase.
9.8 Points cannot be earned if Member was not signed in to the Program at time of purchase.
9.9 Members may not apply Points earned on their own account to other Member accounts.
9.10 If a Member receives a free gift with purchase, Points will not be given for the retail value of the free product.
10. Points Redemption Guidelines
10.1 Members can redeem Points for Product purchases made on the Website only.
10.2 Members must be signed in to the Program to redeem Points.
10.3 Points earned and redeemed are solely for Member personal use.
10.4 Points earned may be redeemed to reduce the purchase price of qualifying Products as per the below scale:
500 Points = $5.00 off
1000 Points = $10.00 off
1500 Points = $15.00 off
2000 Points = $20.00 off
10.5 Points may be redeemed in any combination and in the increment amounts listed.
10.6 Points redemption is subject to product availability.
10.7 Points redemption is subject to the available balance posted at the time of purchase.
10.8 Points cannot be accrued for Products purchased with redeemed Points; however, Points can be accrued for portion of the Retail Price paid after the redeemed Points value has been applied to the transaction.
11. Bonus Points Accrual and Redemption
11.1 Z Palette may provide Members with offers and promotions to earn Bonus Points, through a qualifying Product purchase, or through a non-purchase activity.
11.2 Z Palette will communicate all terms and conditions regarding Bonus Points offers and promotions to Members in writing.
11.3 Bonus Points offers and promotions are subject to the terms and conditions surrounding the offer.
11.4 Bonus Points offers and promotions cannot be combined with any other offer or promotion.
11.5 Z Palette exercises its discretion to offer, alter, or withdraw such offers at any time.
11.6 If a Member receives a free Gift with Purchase (GWP) for a purchase associated with earning Bonus Points, Points and/or Bonus Points will not be given for the retail value of the GWP.
11.7 If a Member redeems Points toward the purchase of a Bonus Point Product, and pays a portion of the Retail Price after Points have been applied to the transaction, Member will receive Bonus Points on the leftover retail amount paid by Member.
11.8 If a Member redeems Points towards the purchase of a Bonus Point product in an amount equal to the full price of the Bonus Point product, Member will not earn any Bonus Points.
12. Application of Points to Account
12.1 Points are applied to Member account within 14 days of the qualifying Product purchase date.
12.2 The timing for issuing Points is subject to change.
12.3 Z Palette is not obligated to make good any loss arising directly or indirectly as a result from failure of Member to uphold the requirements outlined to earn and/or redeem Points.
13. Deduction of Points from Account
13.1 Points may be deducted from a Member account if applied in error or as a result of an error.
13.2 Points may be deducted from a Member account for transactions that have been canceled, reversed, or refunded. Points earned for such transactions will be deducted for an amount equal to the Points earned from the original transaction, including Bonus Points, if applicable.
13.3 Z Palette exercises its discretion to deduct Points from any Member account at any time if Member is currently engaged in, or may engage in, or has engaged in (a) fraudulent and suspected fraudulent activity regarding the accrual and/or redemption of Points; (b) conduct that undermines the legitimate business interests of Z Palette and Z REWARDS; (c) a breach of any and all terms set forth in this Program.
14. Points Expiration
14.1 Points expire at the end of the 12-month anniversary of the date in which the most recent Points were earned, and if Member has not made any qualifying purchase of Products within the same 12-month period.
15. Points Dispute
15.1 Z Palette reserves the right to determine the amount of Points in any Member's account based on Z Palette internal records related to such Member's account.
15.2 Member Points balance as reflected in Z Palette records are considered to be correct.
15.3 Members must contact Z Palette in writing for any and all dispute claims.
15.4 If Member believes Points were not applied for a qualifying purchase made, Member must notify Z Palette in writing within 30 days of the date on which the transaction was made.
15.5 Member waives any and all rights in association with such dispute if Z Palette does not receive notice as requested; and therefore, Z Palette exercises its discretion to no longer investigate such dispute.
15.6 Z Palette may request additional information from Member to investigate such claims, and will communicate such requests during the investigation, as required.
15.7 Upon completion of the investigation of the dispute, regardless of the outcome, Z Palette will consider the outcome as final and absolute, and will have no further engagements, obligations or responsibilities should Member reassert the same dispute.
16. Breach, Termination and Dispute
16.1 Z Palette exercises its discretion to suspend and/or terminate any Member account at any time if Member is currently engaged in, or may engage in, or has engaged in (a) fraudulent and suspected fraudulent activity regarding the accrual and/or redemption of Points; (b) conduct that undermines the legitimate business interests of Z Palette and Z REWARDS; (c) a breach of any and all terms set forth in this Program.
16.2 Member accounts that have been suspended and/or terminated by Z Palette will be communicated of such decision in writing.
16.3 Upon account termination, all Points will be immediately cancelled and the balance of Points will no longer be eligible for use toward future purchases.
16.4 Any and all suspension and/or termination of Member accounts may affect Member eligibility to participate in other Z Palette
16.5 If Member believes that a suspension and/or termination has been made in error, Member must communicate to Z Palette in writing any reasons why such suspension and/or termination is believed to be in error, within fourteen (14) days of termination.
16.6 Z Palette may request additional information from Member to investigate such claims, and will communicate such requests during the investigation, as required.
16.7 Upon completion of the investigation of the dispute, regardless of the outcome, Z Palette will consider the outcome as final and absolute, and will have no further engagements, obligations or responsibilities should Member reassert the same dispute.
17. Variance of Terms and Termination
17.1 Members agree to be bound by the terms and conditions set forth in this Program.
17.2 Members are responsible to remain knowledgeable about the terms and conditions of this Program.
17.3 Members may cancel Membership at any time. Upon cancellation, any unused Points accrued in Member account will be forfeited and cannot be redeemed.
17.4 Z Palette exercises its discretion to cancel, modify, restrict or withdraw Z REWARDS and any aspect of the Program, at any time, and will provide Members with written notice of such changes made.
17.5 Changes made to Z REWARDS may be made without advance notice to Members.
17.6 Changes made to Z REWARDS may affect Member’s ability to use Points already accumulated.
17.7 Z Palette exercises its right to revoke Membership and its associated Rewards and Benefits if Member has committed a breach to any of terms of this Program.
17.8 Any failure or delay by Z Palette in exercising its rights under these terms and conditions does not constitute a waiver of those rights. Any specific waiver by Z Palette regarding the terms and conditions of Z REWARDS will be made in writing and signed by an authorized representative of Z Palette.
17.9 If Z Palette terminates Z REWARDS, and the balance of Points in Member account is less than 500 Points, then such balance of Points and its associated redemption value will be cancelled, and therefore unable to be applied for future purchases. Any Point balances above 500 Points will be issued a voucher to the US dollar value of the tier in which the Points reside, and can be applied toward future purchases.
